National Ethics Application Form (NEAF) (www.neaf.gov.au) Terms and Conditions of Use

1        About this Terms and Conditions of Use Statement

1.1   Please read this Terms and Conditions of Use Statement [herein 'Statement'] carefully as it governs your use of NEAF. Keep a copy of this Statement with your important papers. Before using NEAF, it is important that you know your rights and obligations so that you can gain maximum benefit from the services NEAF offers and, at the same time, have maximum protection for your ethics applications.

1.2   This Statement is to be read in conjunction with the privacy, copyright and disclaimer notices provided on the NEAF website.  This Statement is intended to give the NEAF users a clear indication of what is termed as fair use of the NEAF (www.neaf.gov.au) services.

1.3   To print this Statement, open the following link (https://www.neaf.gov.au/DynamicContent.aspx?code=TERMSOFUSE) and press the "Ctrl" and "p" buttons when using a Windows operating system, the "Apple" and "p" keys when using a Macintosh operating system, or the "Alt" and "p" keys when using an UNIX operating system; or, you can download this Statement to your computer or PDA.  By using NEAF, you agree that you have been given an opportunity to retain this Statement for subsequent reference. In the absence of a specific request by you, you will not otherwise be provided with a copy of the information. 

2        Legal Notice

2.1   Your use of all material and services on the www.neaf.gov.au website is governed by the following terms and conditions.

2.2   You agree that your first use of NEAF will constitute your agreement to these Terms and Conditions and that you agree to use NEAF solely as provided by these Terms and Conditions. You should ensure that you have read and understood these Terms and Conditions.

2.3   Use of NEAF will enable you to provide information for review and evaluation by a relevant Human Ethics Research Committee (HREC) or committees. NEAF is not designed to presume an outcome of these reviews and evaluations.

2.4   NEAF has been designed to collect information necessary for an HREC to review an application and evaluate whether or not the application meets relevant requirements.  However, NEAF does not warrant that its use will meet the information or other needs of HRECs to which an application is submitted.

2.5   This form is only for the purpose of applying to HRECs within Australia.

2.6   Measures have been taken to ensure availability and security of the information entered, stored in or transmitted through www.neaf.gov.au, however;

a)       the computer which the User enters the information must be secure and free from viruses / malware,

b)       there is no guarantee that information will be available at all times, and

c)       www.neaf.gov.au is unable to take responsibility for any lost information.

2.7   Before relying on the material provided in or accessed through www.neaf.gov.au in any important matter, Users are advised to carefully evaluate its accuracy, currency, completeness and relevance for their purposes, and should obtain any appropriate advice relevant to their particular circumstances.

2.8   Material provided in or accessed through www.neaf.gov.au is assembled in good faith, but does not necessarily reflect the considered views of the NHMRC, any institution or HREC, or indicate a commitment to a particular course of action.

2.9   Links to other websites are inserted for convenience and do not constitute endorsement of material at those sites, or any associated organisation, product or service.

2.10  The Reference Material section of this site contains a number of documents written during the development of www.neaf.gov.au that may not fully reflect the current policy and procedures of the HREC to which approval is sought.

2.11  www.neaf.gov.au has been built with the best endeavours to ensure the reliable operation of the website, the protection of personal information and the confidentiality of transactions by Users. Other than any liability imposed by law, however, www.neaf.gov.au will not be responsible for damages associated with either failure of the service or disclosure of information resulting from unauthorised use and intrusion into the system or other circumstance beyond its control.

2.12  You acknowledge that any service provided by www.neaf.gov.au may be   terminated at any time at the total discretion of www.neaf.gov.au.

3        Information about users

3.1   Emails containing passwords could potentially be intercepted, and every time a password is sent in an email (such as requesting a forgotten password) it is recommended that the User change the password afterwards.

3.2   Users may choose or decline to have their details included in a list that other Users can search for the purposes of then inviting that User or those Users to access their research ethics proposals.  Users who opt to have their detials included in this searchable list can choose between two levels of inclusion: either 1) having their first name, surname, email address, organisation and username included; or 2) having just their username included.  This search list will also be accessible to those who maintain www.neaf.gov.au.

3.3   NEAF will use your personal information for the purpose of providing you with NEAF services. Your personal information may be disclosed to organisations that assist NEAF with the provision of these services. For further information on NEAF’s privacy policies you can click on the Privacy link of the website www.neaf.com.au or request a copy of our Privacy Policy brochure from the Help Line.

3.4   You may suspend or terminate the transmission to you of the NEAF service by logging on to the NEAF site and disabling the relevant services or contacting the Help Line and requesting this to be done on your behalf.

3.5   NEAF may monitor transactions and your use of NEAF for quality control purposes.

4        Removal of proposals from the NEAF System

Proposals that have not been accessed within 12 months will be deleted.  Users will be sent email messages from NEAF informing them that this is to occur prior to the deletion of proposals.

5        Service Availability

NEAF is available 24 hours a day, 7 days a week. However, some or all of the services that may be accessed through NEAF may not be available at certain times due to the maintenance, non-use or malfunction of NEAF. In the event of such unavailability, you may call NEAF Assist on 1800 500 983 (within Australia) or +61 2 6217 9070  (from overseas through the international operator).  Times of operation of NEAF Assist are 9AM-5PM AEST, Monday to Friday (public holidays excluded). 

6        Information

6.1   Information provided on www.neaf.gov.au is for general guidance only.  In the case of any dispute as to the interpretation please contact NEAF Assist on 1800 500 983 between 9AM-5PM, Monday to Friday AEST (excluding public holidays).

6.2   Where NEAF provides you with any information which has been obtained from any third party, you acknowledge and agree that NEAF does not thereby warrant the accuracy or completeness of any such third party information.

7        Proprietary Rights in NEAF

You acknowledge that all proprietary rights (including without limitation title, patent rights and copyright) in NEAF (including without limitation the NEAF Internet site) shall at all times vest and remain vested in the Commonwealth of Australia.

8        Your Indemnity

8.1   You will be liable for and indemnify NEAF against any loss or damage which NEAF will or may incur because you did not observe your obligations under this Statement or you acted negligently or fraudulently in using NEAF.

8.2   Please report any potential breaches of security or fair use to the NEAF Help Line.

9        Changes to this Statement

Changes will be made to these terms of use statement as required when new policies or services are introduced. This policy was last updated on 28 September 2012.

11    Entire Agreement

These Terms and Conditions constitute the entire understanding between us and you relating to NEAF and supersedes all proposals, prior arrangements, oral or written and any other communications between us and you in relation to NEAF.

12    Governing Law

The Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New South Wales. We and you expressly agree to submit any dispute arising out of or relating to these Terms and Conditions to the non-exclusive jurisdiction of the courts of New South Wales.
